1. Introduction

(a)           This Privacy Policy (Policy) explains:

(i)            how we collect and use personal information;

(ii)           the circumstances in which we might disclose personal information to third parties;

(iii)          how you may access your personal information held by us; and

(iv)          what you can do if you are unhappy with our treatment of your personal information.

(b)           In this Policy, the terms we, us and our refer to Solo Energy Corporation Pty Limited (ACN 676 921 181) and each of our related bodies corporate, including Solo Energy Australia Pty Ltd (ACN 677 165 472).

(c)           We may make changes to this Policy from time to time without notice effective upon publication on www.solocorp.com.au.

2. Who does this Policy apply to?

This Policy applies to any person in respect of whom we currently hold, or may in the future collect, personal information. This may include any of our customers, commission agents members of any loyalty program or promotion or communication subscription, job applicants, contractors and suppliers.

3. What information does this Policy apply to?

(a)           Personal information is information or an opinion about an identified individual or an individual who is reasonably identifiable, whether true or not, and whether recorded in a material form or not.

(b)           This Policy applies to any personal information we collect. This may include, depending on the circumstances:

(i)            contact details, such as your name, date of birth, address, email address and phone number;

(ii)           details of the products or services you have purchased from us;

(iii)          bank account or credit card details;

(iv)          financial or credit information;

(v)           your logs and browsing on our and our partners’ websites and apps; and

(vi)          photographs and video footage of you and/or your vehicle (including vehicle registration number) at any of our sites.

(c)           For employees or prospective employees or contractors it may include, health information, drivers licence details, work experience and other qualifications, permits and government identifiers and other assessments involving personal or sensitive information required to assess or validate suitability of engagement.

4. How and when do we collect personal information?

(a)           We collect personal information in a variety of ways in the course of conducting our business, including:

(i)            directly from you, including when you:

(A)          provide information by phone or email to us;

(B)          submit your personal details to us through our website (such as via our enquiry form);

(C)          sign up for any services or programs we offer, such as loyalty or rewards programs) (Programs);

(D)          apply to be one of our commission agents or wholesale customers or agree to guarantee the performance of one our commission agents or wholesale customers;

(E)          apply to work with us as a supplier, contractor or other personnel (including through our recruitment process and any health assessments);

(F)           interact with us, including:

(1)           when you purchase or use our products and services;

(2)           submit a complaint regarding our products and services or the locations from where we operate our business; and

(3)           via our websites and any social media accounts; and

(G)          enter any trade promotion or competition; and

(ii)           via security video surveillance at our sites, which include service stations, facilities, depots and other physical locations owned or operated by or on our behalf; and

(iii)          where it is not reasonably practicable to collect personal information directly from you, we may collect your personal information from a third party, such as:

(A)          from a source of publicly available information;

(B)          an employer or former employer (e.g. where a contractor provides personal information about its staff or to conduct suitability checks for job applicants);

(C)          credit reporting agencies; and

(D)          our commission agents and service providers.

(b)           At or soon after the time when we collect personal information, we will take reasonable steps to ensure that you are aware of the way in which your personal information will be handled, the purpose(s) of the collection, the main consequences (if any) if the information is not collected, the types of organisation (if any) to which the information may be disclosed (including those located overseas), any law that required the particular information to be collected (if applicable).

(c)           Personal information collected by us is held in a variety of formats, including hard copy format, on our computer and our cloud network systems.

(d)           If we receive unsolicited personal information and we determine that collection of that information is not permitted under the Australian Privacy Principles we will destroy or de-identify the information if it is lawful and reasonable to do so.

(e)           Where practicable, you may deal with us anonymously or by pseudonym. However, certain transactions will require verification of your identity, for example, recruitment activities and commercial contracts may not be conducted anonymously or by pseudonym. Also, membership to any Program may not be anonymous as we will require your identification to manage and provide you with your membership, promotion, loyalty program and the offers and services flowing from those Programs.

5. Collection of sensitive information

(a)           We will not collect sensitive information about you unless you consent to the collection and the information is reasonably necessary for one or more of our functions or activities, except where the collection is required or authorised by law.

(b)           For certain roles, we require information regarding your health fitness for the role, so sensitive health information will be collected either directly from you or from health service providers.

(c)           Sensitive information includes personal information about you that is also health information, information about your racial or ethnic origin, sexual orientation, criminal record, political associations, trade union membership, biometric information. 6. How do we use personal information?

(a)           We may use personal information for its primary purpose of collection (and reasonably expected secondary purposes) and any other purposes permitted by law.

(b)           For example, we may use your personal information to:

(i)            respond to your enquiries, complaints or concerns;

(ii)           provide you with our products and services;

(iii)          conduct checks for credit-worthiness and for fraud;

(iv)          administer our website and personalise your experience on it;

(v)           prevent, investigate or respond to any actual or suspected theft, violence, fraud and other unlawful activity or misconduct; and

(vi)          research and develop our products and services.

(c)           We may also from time to time use personal information for promotional or direct marketing purposes where permitted under law. You may, at any time, request that we do not to use your personal information for sending direct marketing material. Such a request can be made by clicking on the unsubscribe link at the bottom of any marketing email you receive, or contacting us either in writing, by email or post to the address set out in section 15 below. There is no fee for making such a request.

7. Disclosure of personal information

(a)           We respect your right to privacy and we take reasonable steps to keep your personal information confidential.

(b)           However, we may disclose personal information to third parties in connection with conducting our business, including:

(i)            our related bodies corporate;

(ii)           to our contractors, service providers and agents, who assist us to operate our business, including:

(A)          our commission agents;

(B)          service providers and co-promoters involved in any of our Programs;

(C)          transport providers;

(D)          providers of data storage, collation, processing and analysis services; and

(E)          technology providers, including those who assist us in detecting and preventing theft;

(iii)          to relevant third parties in relation to any potential sale of any of our businesses or corporate entities; and

(iv)          to credit reporting agencies and credit providers, to assist in assessing any applications for a credit account.

(c)           We may also disclose personal information to law enforcement agencies, government agencies or other third parties, where required under or permitted by law.

(d)           Where disclosure of personal information to third parties is necessary, we will seek to require that the third party undertake to take appropriate measures to protect your personal information.

(e)           We do not engage in the business of selling personal information.

(f)            Some of the third parties to whom we disclose your personal information may be located overseas.

8. Information Security

(a)           We will take reasonable steps to ensure that all personal information held by us is secure from any unauthorised access or disclosure.

(b)           We will take reasonable steps to destroy or permanently de-identify personal information if it is no longer needed for the purposes for which we are authorised to use it.

9. Accessing personal information

(a)           You may request to access personal information about you held by us. Such a request must be made in writing to the address below and, so that we can protect personal information from being accessed by unauthorised individuals, you will need to verify your identity before we can complete processing any access request. We endeavour to process any request within 30 days.

(b)           We will grant you access to your personal information as soon as possible, subject to the circumstances of the request.

(c)           A request to access personal information may be rejected if we have valid grounds to do so, including where:

(i)            the request is frivolous or vexatious;

(ii)           providing access would have an unreasonable impact on the privacy of another person;

(iii)          providing access would pose a serious and imminent threat to the life or health of any person;

(iv)          providing access would prejudice our legal rights; or

(v)           there are other legal grounds to deny the request.

(d)           We may charge a fee for reasonable costs incurred in giving access to an individual’s personal information. The fee (if any) will be disclosed prior to it being levied.

10. Correcting personal information

We will take reasonable steps to ensure the accuracy and completeness of the personal information we hold. However, if you believe that any personal information that we hold about you is inaccurate or out of date, then you should contact us in writing at the address set out in section 15 below, and so that we can protect personal information from being changed by unauthorised individuals, you will need to verify your identity before we can complete processing any correction request. We endeavour to process any request within 30 days.

11. Complaints

(a)           If you wish to lodge a complaint about this Policy, or the way in which your personal information is managed, a complaint may be lodged in writing by post or by email to the address set out in section 15 below.

(b)           We take complaints seriously and any further action after our initial response to you will vary depending on the nature of your complaint.

(c)           If you are not satisfied with our response, you can submit a complaint to the Office of the Information Commissioner, Australia. To lodge a complaint, visit the ‘Complaints’ section of the Information Commissioner’s website, located at http://www.oaic.gov.au/privacy/privacy-complaints, to obtain the relevant complaint forms, or contact the Information Commissioner’s office.

12. Information regarding credit

(a)           This Policy also applies in relation to our collection and use of credit information of you in connection with any commercial credit provided by us to you.

(b)           The types of credit information that we collect and use for the purpose of assessing an application for commercial credit and administering a commercial account include:

(i)            names, addresses and other contact details;

(ii)           bank account details;

(iii)          driver’s licence details;

(iv)          financial information;

(v)           information on the assets held; and

(vi)          in respect of account holders, guarantors (both prospective and current).

(c)           Such information is collected from the relevant individual and from credit reporting bodies, as well as from publicly available information. We use information collected to create an internal credit assessment report.

(d)          We do not disclose credit information to credit reporting bodies, except for an individual’s identity in order to obtain a credit report from the credit reporting body.

13.2 Why do we use cookies?

We use cookies to learn more about the way you interact with our content and help us to improve your experience when visiting our websites. Some of the cookies we use are session cookies and only last until you close your browser and others are persistent cookies which are stored on your computer for longer. For some of the functions within our websites we use third party suppliers, for example, when you visit a page with videos embedded from or links to YouTube. These videos or links (and any other content from third party suppliers) may contain third party cookies which are subject to the policies of these third party websites.

(a)           any such third party is not subject to this Policy;

(b)           we are not responsible for the privacy practices or products or services of those third parties; and
